✦ General Terms and Conditions
Skyline Bau · Terms and Conditions Version 3.0
General contractor · Renovation · Interior finishing · Shell construction · Demolition
As of 27.09.2026 · Austrian law · ÖNORM B 2110 applies subsidiarily
Skyline Bau is the brand of the construction and renovation division of Bling Bling GmbH. The contracting party for every order is Bling Bling GmbH, company register number FN 611990k, Commercial Court of Vienna (Handelsgericht Wien). Wherever these terms refer to “Skyline Bau”, this means Bling Bling GmbH acting under this brand.
Every placing of an order with Skyline Bau — whether by handshake, email, WhatsApp, telephone, by payment of a deposit, by granting access to the construction site or by accepting the work without objection — constitutes full and express acknowledgement of these General Terms and Conditions.
ÖNORM B 2110 and the trade-specific standards ÖNORM B 2210, B 3691, B 5320 and B 7220 apply subsidiarily. The version valid at the time the contract is concluded is authoritative and can be viewed at skylinebau.com/agb.
§ 1Scope
1.1These terms apply to all contracts between Bling Bling GmbH, acting under the brand Skyline Bau (FN 611990k, Commercial Court of Vienna, VAT ID ATU80299348, Peak Vienna, Floridsdorfer Hauptstraße 1 / 25th floor, 1210 Vienna), and its clients for construction, renovation and demolition work and for the supply of goods and vouchers.
1.2They cover in particular:
- General contractor and turnkey contractor (Generalübernehmer) services
- Complete renovation, renovation of period buildings and tenement buildings (Zinshaus), flat renovation
- Interior finishing, drywall construction, loft conversion, adding a storey, extensions
- Shell construction, masonry work, concrete work, ground slabs, basement waterproofing
- Demolition, strip-out, excavation, earthworks, disposal
- ETICS facade insulation (WDVS), installation of windows and doors, roof waterproofing, terrace construction, paving
- Bathroom, flooring and painting work, post-construction cleaning
- Heating, ventilation, plumbing (HKLS) and electrical installations via licensed partner firms (§ 5, § 9)
- Supply of goods and vouchers
1.3The version valid at the time the contract is concluded is authoritative. The current version can be viewed at skylinebau.com/agb.
1.4Deviating, conflicting or supplementary terms of the client do not become part of the contract — not even if the work is accepted without comment — without the express written consent of Skyline Bau.
1.5These terms apply both to consumers within the meaning of the Austrian Consumer Protection Act (KSchG) and to businesses. With respect to consumers, mandatory statutory provisions take precedence over any deviating provision of these terms; to that extent, the clause concerned is deemed not to have been agreed.
1.6Amendments to the contract, side agreements and assurances must be made in writing to be effective. Email, WhatsApp, SMS and other electronic text messages count as written form.
1.7ÖNORM B 2110 and the trade-specific standards ÖNORM B 2210, B 3691, B 5320 and B 7220 apply subsidiarily.
§ 2Conclusion of contract — binding without a signature
A binding construction contract comes into being even without a handwritten signature — by email, WhatsApp, verbal agreement, transfer of a deposit, granting access to the construction site or acceptance of the work without objection.
2.1Binding period: quotes are subject to change; binding promotional prices are valid for 14 days from the date of issue. Once the promotional period has expired, the standard price applies automatically.
2.2A binding contract is concluded without a handwritten signature by:
- placing an order in writing (letter, fax)
- placing an order by email, even without a digital signature
- placing an order via WhatsApp, SMS, Signal, Telegram or another messenger
- placing an order by telephone, recorded in a file note by Skyline Bau
- confirmation via the online enquiry form on skylinebau.com
- receipt of a deposit in the account of Bling Bling GmbH
- conduct implying consent under § 863 ABGB (Austrian Civil Code) — granting access to the construction site, accepting the work, agreeing to the start of work
2.3A contract is concluded in particular if the client says “fine”, “ok”, “yes” or “please go ahead” by email, WhatsApp or verbally, or agrees in words to that effect — if they grant employees access to the construction site — if they tolerate the start of work without objecting in writing within seven days — or if they receive invoices without raising an objection within 14 days.
2.4Conclusion of contract by conduct (§ 863 ABGB): if Skyline Bau performs work on the basis of a quote and the client accepts it without objection, the contract is deemed to have been concluded on the terms of the quote plus these terms.
2.5Evidence: recordings of orders placed by telephone and WhatsApp voice messages are admitted as evidence, provided they were obtained lawfully. The client is informed of a recording before it begins and may object to it.
2.6Property managers, developers and commercial clients: continuous acceptance of recurring services over a period of at least 30 days counts as a fully valid written conclusion of contract, with all the consequences of these terms.
2.7Promotional prices lapse retroactively if the order is placed late, after the promotional period has expired, or in the event of late payment. The standard price then applies; the client owes the difference.
§ 3Enquiries via the website
3.1The presentation of services and goods on skylinebau.com is an invitation to submit an offer and not a binding offer by Skyline Bau.
3.2By submitting an enquiry via the form or placing an order, the client makes a binding offer.
3.3Automated acknowledgements of receipt do not yet constitute acceptance. Acceptance takes place by separate order confirmation within 14 days or by the actual start of work.
3.4Skyline Bau is entitled to decline to conclude contracts without giving reasons.
§ 4Contract term, withdrawal & termination
Once the deposit has been received or construction has started, the client may only withdraw against full compensation for the work performed so far, the materials ordered and the loss of profit (§ 1168 ABGB). Any right of withdrawal the consumer may have under § 11 FAGG (Austrian Distance and Off-Premises Contracts Act) remains unaffected (§ 14).
4.1Construction contracts and one-off services are contracts for work (Werkverträge) and end with proper handover.
4.2If no one-off service is agreed, the contract applies for an indefinite period as a continuing obligation.
4.3Ordinary termination of continuing obligations: three months' notice for both parties, to the end of a month, in writing to office@skylinebau.com or by registered letter to the business address.
4.4Withdrawal by the client after construction has started: under § 1168 ABGB, the agreed remuneration is owed, less the expenses actually saved and less whatever Skyline Bau earns, or culpably fails to earn, by using the freed-up capacity elsewhere. Materials already ordered on a binding basis and employee capacity already firmly scheduled are deemed not to have been saved to the extent that they cannot be used elsewhere; Skyline Bau provides the proof of this.
4.5Extraordinary termination of a continuing obligation is only permitted in the event of a demonstrable serious breach of contract by the other party, after a prior written warning with a specific description of the defects and after a grace period of at least 14 days has expired without result. The following in particular do not constitute good cause: subjective dissatisfaction without objective defects, switching to a cheaper provider or an internal restructuring of the client.
4.6Termination by refusal of access, lock-out or simply not granting access to the construction site is deemed an unjustified termination with the legal consequences set out in point 4.4.
4.7Skyline Bau may withdraw in the event of late payment of more than 14 days, refusal of access to the construction site, lack of cooperation, insolvency or self-administration proceedings, and serious breach of contract.
§ 5Scope of work & trade licences
Skyline Bau is a restricted building trade business (Baugewerbetreibender) under § 99 GewO (Austrian Trade Regulation Act) and not a licensed master builder (konzessionierter Baumeister). Planning, structural engineering and permit submissions under § 94 no. 5 GewO, as well as electrical, gas, plumbing, heating and ventilation work, are carried out exclusively by licensed partner firms, which are named in the quote.
5.1What is owed is the work described in the quote, carried out professionally in accordance with the generally accepted rules of technology and the relevant ÖNORM standards.
5.2Regulated trades are carried out by licensed partner firms — under the same contract and the same site management. The client has one contact person, one invoice and one address for warranty claims.
5.3Tolerances: differences in colour, gloss and texture in partial repairs, at connecting joints and at transitions between old and new material are inherent in craftsmanship and do not constitute a defect, provided they remain within the relevant ÖNORM tolerances.
5.4Prices are only stated after the property has been inspected. Amounts mentioned before the inspection are non-binding estimates of magnitude and do not give rise to any claim.
§ 6Construction site, client-supplied items & cooperation
6.1The client provides the following free of charge: construction water (cold), construction power at 230 V and 400 V, a sanitary facility, a space to set up the skip, and storage and parking areas within reasonable proximity of the construction site.
6.2The client ensures unobstructed access, obtains the no-parking order where required, and clears the work areas of furnishings, stored goods and vehicles in good time.
6.3Material supplied by the client is at the client's cost and risk. Skyline Bau accepts no liability for the suitability, quantity or defects of client-supplied material.
6.4Downtime costs: if work cannot be carried out due to lack of cooperation by the client, areas not cleared, missing client-supplied items or refusal of access, EUR 600.00 net will be charged per day and per employee deployed. Skyline Bau reports the obstruction in writing without delay and limits the downtime through reasonable rescheduling.
6.5No warranty or security retention is agreed.
§ 7Hidden defects, asbestos & contaminated materials
If hidden defects come to light during renovation or demolition work — mould, asbestos, man-made mineral fibres, rotten timber beams, leaking pipes, old hazardous building materials, undocumented installations — the resulting additional work and the costs of special materials and disposal are borne by the client, even where a lump-sum price has been agreed.
7.1The lump-sum price covers only the condition recognisable at the inspection. Whatever was concealed behind cladding, under screeds, in shafts or within the building fabric cannot be calculated and is therefore not included.
7.2Skyline Bau reports a hidden finding in writing without delay, stops work in the affected area and submits a variation under § 15 before continuing. Without this notification, there is no entitlement to additional costs.
7.3Asbestos and other hazardous substances are removed and disposed of exclusively by licensed specialist firms in accordance with the provisions of the Austrian Limit Values Ordinance (Grenzwerteverordnung) and the employee protection regulations. The costs are borne by the client.
7.4The client provides existing as-built drawings, utility plans, hazardous substance reports and knowledge of previous alterations without being asked. If this is not done, the client bears the consequences of any resulting damage and delays.
§ 8Deadlines, weather & force majeure
Weather-related delays — frost below 0 °C, persistent rain, snowfall, storms, heat above 35 °C — are not attributable to Skyline Bau and lead to a reasonable extension of the construction period without any penalty.
8.1Agreed dates are target dates unless they have been expressly agreed in writing as a “fixed date”.
8.2Force majeure — pandemic, supply chain disruption, strike, official order, energy shortage, flooding, war — entitles Skyline Bau to extend the completion period without the client being entitled to damages.
8.3Delays caused by late preceding trades, lack of cooperation by the client, failure to supply materials or missing official permits extend the construction period accordingly.
8.4A contractual penalty for missing deadlines only applies if it has been expressly agreed in writing.
§ 9Subcontractors & partner firms
9.1Skyline Bau is entitled to have work carried out in whole or in part by qualified subcontractors and partner firms.
9.2Payment is made exclusively to Skyline Bau. Direct payments to subcontractors do not discharge the client.
9.3Work performed by subcontractors is deemed to have been performed by Skyline Bau itself. Skyline Bau is liable for its subcontractors as for its own staff.
9.4There is no entitlement to be informed of the subcontractors deployed unless statutory provisions require disclosure (protection of supply sources, § 24).
§ 10Official permits & BauKG
10.1Building permits, building notifications, structural reports, heritage protection decisions, consents from co-owners and the property management, and any other approvals must be obtained by the client in good time, in full and at their own expense.
10.2If more than one construction company works on the site, the client must appoint a planning and site coordinator under the Austrian Construction Work Coordination Act (BauKG). Skyline Bau can take on this role subject to a separate written agreement and separate remuneration.
10.3If required permits are missing when work is due to start, the obligation to perform is suspended until they are presented. The construction period is extended accordingly; downtime costs under point 6.4 remain reserved.
§ 11Remuneration & payment terms
11.1Standard for construction work, unless otherwise agreed in writing: 60% deposit when the order is placed, 40% final invoice after completion. For large projects, alternatively a 60% deposit, a 25% instalment once construction is 50% complete and a 15% final payment.
11.2Each instalment is due within seven days net of the invoice date, without deduction.
11.3For longer projects, interim invoices according to construction progress are permitted and fall due separately.
11.4Set-off is only permitted against counterclaims that are undisputed or have been established by a final court decision. With respect to consumers, this restriction does not apply in the event of Skyline Bau's insolvency or to counterclaims arising from the same contractual relationship (§ 6 (1) no. 8 KSchG).
11.5Several clients — co-owners, spouses, companies — are jointly and severally liable (§ 891 ABGB).
11.6Deposit requirement: for first orders, for orders above EUR 5,000.00 net or where proof of creditworthiness is lacking, a deposit of up to 50% may be requested.
11.7Cash discount: 2% for payment within seven days of the invoice date, excluding deposits, promotional prices, variations and cancellation fees.
11.8Price adjustment: for contract terms exceeding six months, or in the event of a construction delay of more than 90 days for which the client is responsible, an adjustment may be made in line with the Austrian construction cost index (BKI) or the consumer price index (VPI). It will be announced in writing at least 30 days in advance and must be substantiated in a verifiable manner. With respect to consumers, it applies only in accordance with § 6 (1) no. 5 KSchG.
11.9Ancillary costs flat rate: for construction projects, a flat rate for ancillary costs of up to 6% of the contract sum may be charged — for rubble disposal, small materials, logistics and insurance. It must be shown in the quote.
11.10Loss of instalment benefit: where payment by instalments has been agreed, the entire outstanding balance falls due immediately if an instalment remains unpaid. With respect to consumers, this applies only under the conditions of § 13 KSchG — Skyline Bau's work must already have been performed, the instalment must have been overdue for at least six weeks, and the consumer must have been sent a reminder, without success, threatening loss of the instalment benefit and setting a grace period of at least two weeks.
§ 12Late payment, reminder fees, debt collection
12.1Default interest for businesses: 9.2 percentage points above the base rate (§ 456 UGB, Austrian Commercial Code). For consumers: 4% per year (§ 1000 ABGB).
12.2Reminder fees for businesses: a flat EUR 40.00 as compensation for recovery costs (§ 458 UGB). For consumers, only the costs actually incurred, necessary for appropriate recovery and reasonably proportionate to the claim are charged (§ 1333 (2) ABGB).
12.3Debt collection costs under the Austrian Debt Collection Fees Ordinance (Inkasso-Tarifverordnung) and legal fees for out-of-court and court recovery must be reimbursed within the scope of point 12.2.
12.4Suspension of work: from the 15th day after the due date, Skyline Bau is entitled, after prior written notice, to suspend work and shut down the construction site, without the client being entitled to damages as a result. The construction period is extended by the duration of the suspension.
§ 13Travel & hourly rates
- Flat travel fee Vienna
- EUR 172.00 net per journey
- Outside Vienna
- plus EUR 1.00 net per kilometre in each direction
- Hourly rate (Regie)
- EUR 90.00 net per employee and per hour or part thereof for work outside the lump-sum price
- Downtime costs
- EUR 600.00 net per day and employee (§ 6.4)
13.1All amounts are net, plus VAT at the applicable statutory rate. For construction work for businesses, the reverse-charge procedure under § 19 (1a) UStG (Austrian VAT Act) may apply.
§ 14Right of withdrawal & cancellation
14.1For contracts concluded off-premises or at a distance, consumers have a right of withdrawal of 14 days under § 11 FAGG. If the consumer expressly requests that work begin before the period expires, they must pay a proportionate amount for the work already performed if they withdraw (§ 16 FAGG). The right of withdrawal lapses once the service has been fully performed, if the consumer has expressly agreed to the start before the period expired and has confirmed their awareness of losing the right of withdrawal.
14.2Cancellation fees for businesses, calculated on the net order value:
| Time of cancellation before construction starts | Cancellation fee |
|---|---|
| 30 days or more before | 20 % |
| 14 to 29 days before | 35 % |
| 7 to 13 days before | 50 % |
| 24 hours to 6 days before | 75 % |
| Less than 24 hours before or on the day construction starts | 100 % |
| After construction has started | Contract price under § 1168 ABGB |
14.3Materials already ordered on a binding basis, subcontractor services already commissioned and official registrations — such as a no-parking zone or crane permit — must also be reimbursed, to the extent that they cannot be used elsewhere.
14.4With respect to consumers, the rates under point 14.2 apply as liquidated damages. The consumer is free to prove that no damage or substantially less damage has been incurred; judicial moderation under § 1336 (2) ABGB remains unaffected.
14.5Background: the date is firmly reserved, employees are scheduled and materials are ordered. The shorter the notice of cancellation, the less the freed-up capacity can still be reallocated.
§ 15Additional work & variations
All work not included in the original order must be notified in writing before it is carried out. If there is no response within five working days of verifiable notification, the variation is deemed approved. With respect to consumers, silence does not count as consent; express approval is required there.
15.1The variation states the work, quantity, price and effect on the construction period.
15.2Additional work instructed by the client but not approved in writing is charged at EUR 90.00 net per hour and employee, plus materials and a 15% surcharge.
15.3Promotional prices and flat-rate discounts on the main order do not apply to variations.
15.4Verbal instructions on site are recorded in the site diary under § 21.
§ 16Goods, vouchers & retention of title
16.1Delivery within 14 days of receipt of payment, unless otherwise agreed. Delivery dates are approximate.
16.2Retention of title: Bling Bling GmbH remains the owner of all goods delivered and materials installed until full payment of all claims arising from the business relationship, unless the materials have passed into the ownership of the property owner by being joined to the land under §§ 414 et seq. ABGB.
16.3In the event of late payment, Skyline Bau is entitled, after prior written notice and the setting of a grace period, to take back materials that have not yet been permanently fixed. The costs are borne by the client.
16.4Return of undamaged goods: 20% handling fee on the net value of the goods. Promotional goods are excluded from return. Return transport by Skyline Bau: at least EUR 172.00 net plus hourly charges under § 13. Consumers' statutory rights of withdrawal remain unaffected.
16.5Vouchers are valid for three years from issue, transferable and cannot be redeemed for cash.
16.6For deliveries of goods to businesses, risk passes when the goods are loaded at Skyline Bau. For consumers, risk only passes upon handover to the consumer (§ 7b KSchG).
16.7Product liability: recourse under § 12 PHG (Austrian Product Liability Act) is excluded with respect to businesses, except where caused intentionally or through gross negligence. The manufacturer or EU importer will be disclosed on request within three months. Safety data sheets and warnings must not be altered or removed.
§ 17Handover & acceptance
17.1Handover takes place at a joint appointment and is recorded in a handover report.
17.2Minor defects do not entitle the client to refuse handover. They are recorded in the report and remedied within a reasonable period.
17.3Actually putting the work into operation, moving in or using it also counts as handover.
17.4If the client fails to attend the handover appointment without good cause despite verifiable notification and a reasonable notice period, handover is deemed to have taken place 14 days after the scheduled date. Skyline Bau expressly points out this consequence in the notification.
§ 18Warranty
- Consumers, construction work on immovable property
- 3 years from handover (§ 933 ABGB)
- Consumers, movable items and goods
- 2 years from delivery
- Businesses, construction work
- 12 months from handover
- Businesses, goods
- 6 months from delivery
18.1Notification of defects: visible defects must be reported in writing with a specific description within 14 days of handover. For consumers, the warranty is not conditional on meeting this deadline; there it serves to ensure prompt remedy. Businesses are subject to the duty to give notice of defects under § 377 UGB.
18.2A general complaint without a specific description of the defects is not an effective notification of defects.
18.3Skyline Bau is entitled to remedy defects. The period for remedial work is at least 14 working days from receipt of the notification, or, for weather-dependent work, from the next suitable period of weather. The client must grant access for the remedial work.
18.4The following are not defects: wear and tear through intended use, damage caused by improper use or care, settlement cracks to the usual extent, damage resulting from material supplied by the client or from third-party preceding trades, and deviations within the ÖNORM tolerances (§ 5.3).
§ 19Liability & notification of damage
19.1Skyline Bau has unlimited liability for intent and gross negligence.
19.2With respect to businesses, liability for slight negligence applies only in the event of a breach of essential contractual obligations and is limited to the business liability insurance cover of EUR 3,000,000.00. With respect to consumers, the statutory provisions apply.
19.3Liability for personal injury is not limited. Liability under the Austrian Product Liability Act remains unaffected.
19.4With respect to businesses, there is no liability for consequential damage, loss of profit or loss of data, except in cases of intent or gross negligence.
19.5Claims for damages by businesses become time-barred one year after knowledge of the damage and the party causing it, but no later than the statutory periods. With respect to consumers, the statutory limitation periods apply.
19.6Notification of damage: damage occurring while the work is being carried out must be reported in writing within 48 hours of becoming aware of it, so that the cause and extent can be established jointly. Late notification does not result in loss of the claim, but the client bears the burden of proof for the cause and amount of the damage to the extent that establishing them has been made more difficult by the delay.
19.7Damage is documented and recorded in the presence of the client or their representative.
§ 20Insurance
20.1Skyline Bau maintains business liability insurance with cover of EUR 3,000,000.00 for personal injury, property damage and financial loss.
20.2Contractors' all-risk insurance or insurance of the construction project against natural hazards is the responsibility of the client, unless expressly agreed otherwise in writing.
20.3Property of the client that remains in the work area must be removed or covered by the client. Liability for items left behind applies only in cases of intent and gross negligence.
§ 21Site diary & documentation
Every entry in the site diary — electronic or handwritten — is deemed acknowledged and becomes part of the contract if no written objection is raised within 14 calendar days of its verifiable provision to the client. With respect to consumers, the period does not establish acknowledgement but a rebuttable presumption of the facts recorded.
21.1For construction projects, Skyline Bau keeps a site diary, either electronically (email log, WhatsApp log, construction software) or by hand. Both forms are equivalent.
21.2The following are recorded: working days, employees and subcontractors deployed, deliveries, weather, results of meetings, instructions from the client, obstructions, additional work and special occurrences.
21.3The client may inspect the diary at any time and request countersignature.
21.4Objection period: 14 calendar days from provision, in writing by email, WhatsApp or letter.
21.5Evidential value: in the event of a dispute, the site diary serves as evidence of the scope of work, the period of execution, obstructions and instructions given. It is retained for ten years after completion of the project.
§ 22Non-solicitation of employees
During the term of the contract and for twelve months after it ends, no employee or freelance worker (freier Dienstnehmer) of Skyline Bau or of the subcontractors it deploys may be poached or employed — either directly or indirectly.
22.1In the event of a breach, a contractual penalty of EUR 50,000.00 per person falls due. The right to prove greater damage is reserved.
22.2The prohibition also applies to indirect employment via temporary staffing, subcontractor chains or affiliated companies.
22.3It does not cover an application for a publicly advertised position without prior targeted approach by the client.
§ 23Non-circumvention of partner firms & subcontractors
The client undertakes, during the business relationship and for 24 months after it ends, not to enter into direct business relationships with subcontractors, partner firms, suppliers or supply sources whose identity or contact details it has learned through Skyline Bau — neither directly nor via affiliated companies or related persons.
23.1Protection extends to subcontractors and partner firms that Skyline Bau has deployed or named in order to fulfil the order, as well as suppliers and supply sources for materials, tools and special equipment — such as crane operators, asbestos removal specialists, structural engineers and scaffolders.
23.2Contractual penalty in the event of a breach: EUR 100,000.00 per breach or three times the net order value of the circumvented business, whichever is higher. The penalty falls due without a reminder.
23.3The non-circumvention obligation also binds the client's managing directors, authorised signatories (Prokuristen) and senior employees, affiliated companies within the meaning of § 15 AktG (Austrian Stock Corporation Act) and legal successors of the client's business.
23.4On request, the client must state in writing within 14 days whether, and to what extent, it has done business during the restricted period with subcontractors or suppliers it came to know through Skyline Bau.
23.5Express written approval by the management lifts the non-circumvention obligation in an individual case.
23.6This non-circumvention obligation applies only to businesses. It is not agreed with consumers.
§ 24Confidentiality & protection of supply sources
24.1Both parties keep all confidential information that becomes known to them in the course of the business relationship secret, including after the contract has ended.
24.2Protection extends in particular to the identity and contact details of subcontractors, partner firms and suppliers, supply sources for special materials and equipment, terms, purchase prices and calculation bases, as well as internal know-how and processes.
24.3In the event of a breach by a business, a contractual penalty of EUR 25,000.00 per breach falls due; further damages remain reserved. With respect to consumers, the statutory liability for damages applies.
§ 25Signage & use as a reference
25.1The client permits Skyline Bau company signs and site boards to be put up during the work.
25.2Skyline Bau may document the progress and result of the construction work photographically and use this for reference purposes — on the website, on social networks and in printed material. Identifiable persons and occupied interiors are only published with separate consent.
25.3The client may be named as a reference unless it objects in writing within 30 days of completion of the work. Consent may be withdrawn at any time without giving reasons.
25.4Documentation obligation: business clients retain records of the materials installed and the work carried out for ten years. In the event of a breach, a contractual penalty of EUR 15,000.00 falls due. This obligation does not apply to consumers.
§ 26Overview of contractual penalties and flat rates
For clarity on both sides, here are all the contractual penalties and flat rates agreed in these terms at a glance:
| Circumstance | § | Amount |
|---|---|---|
| Poaching of employees | § 22 | EUR 50,000.00 per person |
| Circumvention of a partner firm or subcontractor | § 23 | EUR 100,000.00 or 3× the order value |
| Breach of confidentiality | § 24 | EUR 25,000.00 per breach |
| Breach of the documentation obligation | § 25.4 | EUR 15,000.00 |
| Cancellation of an order placed | § 14 | 20 to 100% of the order value |
| Construction site downtime | § 6.4 | EUR 600.00 per day and employee |
| Reminder fees for businesses | § 12.2 | EUR 40.00 per reminder |
| Hourly work outside the lump-sum price | § 13 | EUR 90.00 per hour and employee |
26.1The contractual penalties in §§ 22 to 25 apply exclusively to businesses.
26.2They fall due without further reminder and do not exclude a claim for further damages.
26.3The right to judicial moderation under § 1336 (2) ABGB remains unaffected.

With every form of placing an order — in writing, verbally, electronically or by conduct implying consent such as granting access, paying a deposit or accepting the work — the client confirms that it has taken note of and accepts these terms.
Anyone who commissions Skyline Bau — in whatever form — agrees to these terms and conditions. Full stop.
No order without a basis, no dispute without clarity. These terms protect both sides: the client against unclear work, Skyline Bau against unfounded additional claims and against circumvention.
Every quote, invoice and order confirmation contains an express reference to the validity of these terms. Current version: skylinebau.com/agb
